§ 1 DEFINITIONS

Business days – days from Monday to Friday excluding public holidays.
Account – a free service regulated by a separate store policy, allowing the Buyer to create a personal account in the Store.
Consumer – a consumer within the meaning of the Civil Code.
Buyer – any entity purchasing in the Store.
Terms – these Terms and Conditions.
Store – the Killing The Streets online store operated by the Seller at https://ktstunts.com.
Seller – TOMASZ PAWLIKOWSKI, entrepreneur operating under the business name KTS Tomasz Pawlikowski, registered in the Central Registration and Information on Economic Activity, NIP 9471922850, REGON 100925982, ul. Smolika 13, 91-357 Łódź, Poland.

§ 3 TECHNICAL REQUIREMENTS

To properly use the Store, the Buyer needs:

  • a device with internet access

  • a web browser supporting JavaScript and cookies.
    To place an order in the Store, besides the above requirements, an active email account is necessary.


§ 4 PURCHASES IN THE STORE

Prices of goods displayed in the Store are total prices, including VAT.
The Seller emphasizes that the total order price consists of the price of the goods and, where applicable, the shipping costs.
Selected goods must be added to the shopping cart.
The Buyer then selects a delivery method and payment method, and provides necessary details to complete the order.
An order is placed upon confirmation of its contents and acceptance of these Terms by the Buyer.
Placing an order constitutes the conclusion of a sales contract between the Buyer and the Seller.
The Seller shall provide the Consumer with confirmation of the contract on a durable medium no later than at the time of delivery.
The Buyer may register in the Store by creating an Account or purchase without registration by providing data with each order.


§ 5 PAYMENTS

Payments can be made by the Buyer via:

  • Bank transfer to the Seller’s account

  • Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro

  • Payment platforms: Shoper Payments, PayPal
    In case of a refund for a card payment transaction, the Seller will return funds to the bank account linked to the Buyer’s payment card.
    Payments via Shoper Payments are processed by Autopay and PayPro.
    When prepaying, the payment must be made within 7 business days of placing the order.
    Due to the nature of some payment methods, payment may only be possible immediately after placing the order.
    The Buyer agrees to the issuance of electronic invoices but may withdraw this consent.
    PayPro S.A. operates online payments and card processing.


§ 6 RETURNS AND REFUSAL TO ACCEPT CASH ON DELIVERY SHIPMENTS

Choosing cash on delivery means the Buyer agrees to pay shipping costs.
If the Buyer refuses to accept the shipment, they bear the full shipping costs both ways.
According to Consumer Rights Law, if the Consumer did not exercise the right of withdrawal before receiving the goods, the return is at their cost and risk.
Refunds will be made promptly, no later than 14 days after receipt of the returned goods, minus shipping costs borne by the Seller.
The Seller reserves the right to charge the Buyer for return shipping costs if unpaid within the invoice terms.


§ 7 ORDER FULFILLMENT

The Seller is obligated to deliver goods free from defects.
Delivery times are indicated in the Store.
For prepaid orders, processing starts after payment confirmation.
For card payments, processing begins after authorization.
If goods with different delivery times are ordered together, the order is fulfilled according to the longest delivery time.
Delivery is available to Poland and the EU.
Delivery methods include courier services, Polish Post, and InPost parcel lockers.


§ 8 RIGHT OF WITHDRAWAL FROM THE CONTRACT

Consumers may withdraw from the contract within 14 days without giving reasons.
The withdrawal period expires 14 days after the Consumer or a third party (other than the carrier) takes possession of the goods or the last item in multi-item orders.
To exercise the right, the Consumer must notify the Seller via post or email.
A model withdrawal form is attached but not mandatory.
Sending the withdrawal notice before the deadline is sufficient.

Effects of Withdrawal:
The Seller refunds all payments including delivery costs (except for extra costs due to a delivery method chosen by the Consumer) within 14 days of notification.
Refunds use the same payment method unless otherwise agreed.
The Seller may withhold refunds until receiving the goods or proof of return.
Returns must be sent to: ul. Smolika 13, 91-357 Łódź, within 14 days of withdrawal notification.
The Consumer bears the direct cost of returning goods.
Consumers are liable for any diminished value due to improper use beyond checking product characteristics.
Incomplete returns may result in deduction of free gifts’ value from refunds.
Promotional discounts may be recalculated or withdrawn upon partial returns.


§ 9 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply to contracts for:

  • Custom-made goods or goods tailored to Consumer specifications

  • Perishable goods or with short expiry

  • Sealed goods that cannot be returned for hygiene or health reasons if opened

  • Goods inseparably mixed with others

  • Sealed audio, video, or software products if opened

  • Newspapers, periodicals (except subscriptions)

  • Services or goods with prices dependent on financial market fluctuations beyond Seller’s control

  • Digital content not on a physical medium, if performance started with Consumer consent before withdrawal period expires
    Withdrawal right is only for Consumers, not businesses.


§ 10 COMPLAINTS

Buyers may complain about defective goods under statutory warranty (rękojmia) or guarantee if provided.
Consumers may request price reduction, repair, replacement, or withdraw from contract for significant defects.
Complaints should be sent by mail or email to the Seller’s contact.
If necessary, defective goods must be sent to Seller at Seller’s cost.
Warranty terms, if applicable, are listed in product descriptions.
Complaints regarding Store operation should be emailed.
Complaints will be resolved within 14 days.

Alternative dispute resolution:
If complaints are unsatisfactory, Consumers may use mediation via regional Trade Inspection authorities or online dispute resolution platforms.


§ 11 PERSONAL DATA

Seller processes personal data in accordance with privacy laws; details are in the Privacy Policy available in the Store.


§ 12 DISCLAIMERS

Seller is not liable for damages resulting from incorrect use of the Store or force majeure events.

Account – a free service provided by the Store, regulated by these Terms and Conditions, which allows the Buyer to create an individual Account in the Store.
Buyer – any entity purchasing in the Store.

§ 3 TECHNICAL REQUIREMENTS

To properly function and create an Account, the following are required:

  • an active email account

  • a device with Internet access

  • a web browser supporting JavaScript and cookies


§ 4 ACCOUNT

Creating an Account is completely voluntary and depends on the Buyer’s will.
The Account provides the Buyer with additional features such as viewing order history, checking order status, and editing their personal data.
To create an Account, the Buyer must fill out the relevant form in the Store.
At the moment of Account creation, an indefinite contract is concluded between the Buyer and the Seller regarding the management of the Account under these Terms and Conditions.
The Buyer may resign from the Account at any time without any costs.
To resign, the Buyer must send a resignation message to the Seller’s email: kontakt@ktstunts.com, which will result in immediate deletion of the Account and termination of the contract regarding the Account management.


§ 5 COMPLAINTS

Complaints regarding the Account operation should be sent to the email: kontakt@ktstunts.com.
The Seller will respond to complaints within 14 days.

OUT-OF-COURT METHODS FOR COMPLAINTS AND CLAIMS
If the complaint procedure does not produce the expected result for the Consumer, they may use:


§ 6 PERSONAL DATA

The administrator of personal data provided by the Buyer while using the Store is the Seller.
The Buyer’s personal data are mainly processed based on the contract and for its performance, in accordance with the rules set out in the EU General Data Protection Regulation (GDPR). Detailed information on data processing by the Seller is available in the privacy policy published in the Store.


§ 7 RESERVATIONS

It is prohibited for the Buyer to provide unlawful content.
The contract concerning the Account management is concluded in Polish.
In important cases (see section 4 below), the Seller reserves the right to amend these Account Terms and Conditions.
Important reasons include:

  • the necessity to adapt the Store to applicable legal regulations

  • improvement of service security

  • changes in Account functionality requiring Terms and Conditions modifications.
    The Buyer will be informed of planned changes at least 7 days before implementation via email sent to the Account’s registered address.
    If the Buyer does not accept the planned changes, they should inform the Seller by sending an email to kontakt@ktstunts.com, resulting in termination of the contract regarding Account management upon the changes taking effect or earlier if requested by the Buyer.
    If the Buyer does not object to the changes before their entry into force, it is assumed that they accept them, without prejudice to future contract termination rights.
    In case of disputes with a Buyer who is not a Consumer, the competent court is the court having jurisdiction over the Seller’s registered office.
    No provision of these Terms excludes or limits Consumer rights under applicable law.



Newsletter Terms and Conditions
Killing The Streets Store Newsletter Terms and Conditions


§ 1 DEFINITIONS

Newsletter – a free electronic service through which the Subscriber may receive messages from the Provider about the Store, including offers, promotions, and news.
Store – the Killing The Streets online store operated by the Provider at https://ktstunts.com
Provider – TOMASZ PAWLIKOWSKI, entrepreneur conducting business as KTS Tomasz Pawlikowski, registered in the Central Register and Information on Economic Activity, NIP 9471922850, REGON 100925982, address: ul. Smolika 13, 91-357 Łódź, Poland.
Subscriber – any entity using the Newsletter service.


§ 2 NEWSLETTER

Subscription to the Newsletter is voluntary.
To use the Newsletter, a device with a web browser supporting JavaScript and cookies, internet access, and an active email account are required.
Newsletter emails will be sent to the email address provided by the Subscriber upon sign-up.
To subscribe, the Subscriber enters their email address in the designated field on the Store website.
Then, the Provider sends a verification email with a link to confirm subscription. After confirmation, a service contract is concluded and the Provider starts providing the Newsletter service.
Each Newsletter message contains information and a link to unsubscribe.
The Subscriber may unsubscribe at any time without reason or cost by clicking the unsubscribe link or sending an email to kontakt@ktstunts.com.
Unsubscribing results in immediate termination of the Newsletter service contract.


§ 3 COMPLAINTS

Complaints regarding the Newsletter should be sent to kontakt@ktstunts.com.
The Provider will respond within 14 days.


§ 4 PERSONAL DATA

The administrator of personal data provided during Newsletter subscription is the Provider.
Data are processed mainly based on the contract and for its performance, in accordance with GDPR. Detailed information is in the privacy policy on the Store website.


§ 5 FINAL PROVISIONS

The Provider reserves the right to amend the Newsletter Terms for important reasons, such as service modernization or legal changes affecting service provision.
Subscribers will be notified by email at least 7 days before changes take effect.
If no objection is raised before the changes, acceptance is assumed.
If the Subscriber does not accept the changes, they should send a notification to kontakt@ktstunts.com, which will terminate the Newsletter service contract upon the changes’ effective date.
It is prohibited to send unlawful content via the Newsletter.
